Judge Orders South Butt, North Face to Reach Agreement on Un-anatomical Differences

A federal judge has ordered the outdoor clothing giant North Face and the tiny local apparel company it's suing, South Butt, to try to work out a solution to their conflict through mediation during the last few weeks of March.

Albert S. Watkins, attorney for South Butt and its founder, Mizzou freshman Jimmy Winkelmann, said that a court-ordered hashing-out of differences is common in civil cases.

Normally, it follows an exhaustive discovery process, but in this case, Watkins said, "there didn't seem to be any facts in dispute. This one is not complicated."

The implication being that interpreting those facts is the sticking point -- and oh how sticky it's been. We'll leave the substance -- whether or not South Butt is truly a parody, as Watkins insists -- for another post. For now, let's discuss style. We've already bloggedabout Watkins' cheeky answer to North Face's initial claims.

What was interesting was how, last week, the heretofore restrained counsel representing North Face finally showed flashes of its own smart-assery (click herefor the filing). Voila an excerpt:
Defendant Winkelmann may claim to resemble Alfred E. Neuman, but he and his fellow Defendants are hardly publishing Mad Magazine, and their knock-off apparel is a far cry from the parody stickers of The Topps Company's Wacky Packages...

Moreover, their attempt to pass themselves off as fleece-clad soul mates of Weird Al Yankovic reveals the hollowness of their position.
Watkins said he finds it "refreshing" that North Face has "attempted to embrace the levity" he believes this case calls for. But, the lawyer hastened to add, "Their parody of my parody of this case sucks. And I say that with the highest degree of respect for their effort."

Watkins also reports that he's scheduled to go on the Howard Stern radio showThursday afternoon.

Choosing the Best Gear

Uninformed and ignorant buying is a potential invitation to snow mountain hazards. Taking a friend or your coach along helps choose the most suitable and avoid counterfeits. However if alone, check the shells of jackets and shoe uppers for waterproofing qualities. Despite that, waterproofed nylon fabrics breathe and keep you dry inside. I love intense outdoor workouts, even in the dead of winter. What I don’t love is gearing up for them—if I dress warmly enough to keep from freezing when I first head out, I’m bound to overheat once I really get going. So what’s a girl to do? The answer: Get herself the new Animagi Jacket from The North Face(TNF).

The Animagi is an interesting hybrid. The front and back torso and collar are made of very thin PrimaLoft, while the sleeves and side panels are made of a stretchy polyester blend. (Most of the fabric used in the jacket is recycled, which is a big plus in my book.) At first, I was a little skeptical. This is one very light jacket (a mere 9 ounces), and I wasn’t at all convinced it would provide any more warmth than a windbreaker. With some trepidation, I put it on over a wicking turtleneck and a long-sleeve tech shirt, and headed out into the windy, 20ish-degree darkness of the early morning.

I discovered one of the benefits of the jacket right away: Wary of letting my arms get cold, I launched into a brisker-than-usual warm-up. But truly, from the moment I stepped outside, while my arms were indeed a little chilly at first, my core was perfectly warm. When I finally got my serious power-walk going, I didn’t feel cold at all. And when I checked my Fitbitactivity monitor later, I noticed that I’d spent more time than usual in high intensity mode (translation: more calories burned). My guess is that this was because I never felt overheated—because when I start to swelter, I tend to slow down a little.

The North Face guys describe this as a jacket for “cold weather endurance activities,” and they’re not kidding. It’s ideal for everything from power-walking to cross-country skiing—in other words, activities that are truly high intensity. Wear it for a leisurely walk or bike ride and your arms and sides will freeze.

Style-wise, it’s very flattering, fitted but not too tight. The back hem drops slightly (good for blocking back drafts), and there are nice touches like thumb loops over the extra-long sleeves (so no need for gloves if it’s above freezing). It’s also very packable; I could stuff this jacket in the corner of a carry-on or workout bag with no problem.

The only thing that bugs me about this jacket is the lack of reflectivity: The only reflective part is the logo, and that’s not going to make me very visible to oncoming cars during my early morning workouts. Granted, the jacket has a UPF of 30, so it gives sun protection during the day, but during the colder months, most folks who exercise either before or after work are doing so in at least partial darkness. Just something to think about, TNF guys, if you update the Animagi for next year (and I hope you do).

Regardless, the Animagi has earned a permanent place in my workout wardrobe—at least until spring comes.

In Your (North) Face

Combine the Streisand Effect and a trademark lawyer with wit and resources, and you get the South Butt’s Answer to the lawsuit filed against it by the North Face. This is Half Dome versus Half Ass, the bullying socialism of the North Face (according to the Answer) against freedom of speech and the American Dream (ditto). The whole thing reads like a movie script. Some trademark lawyers have all the fun. Fade in!

Seriously: To be sure, the North Face is a well-known mark and the product of millions of dollars of marketing. Yet as the Answer notes, quite correctly, the mark long ago ceased to be associated primarily with a high adventure outdoors lifestyle; North Face products today are often purchased by people with no greater ambition than to scale the heights of the escalator at the mall. (Of course, I own my share of North Face products, though my 4WD vehicle has spent a lot of time in the woods.) That is South Butt’s point, and it’s a legitimate one. You can hardly make your way through a Williams Sonoma store these days without crashing into a mob of North Face-wearing shoppers, fresh from REI.

The question is not simply whether folks can critique and parody the North Face; they can. The question is whether the right to critique and parody the North Face is limited to, say, text (The South Butt’s Jimmy Winkelmann can write an essay and post it on the Internet), or whether the right to critique and parody includes engaging North Face on the same turf where the North Face makes it own case: products and marks. In other words, the North Face (like any mark owner) uses its marks in certain ways to make a kind of case to consumers: buy our stuff, because it’s cool/hip/high quality/whatever the company might want to say and persuade you to believe. Trademarks are about persuasion. Jimmy Winkelmann doesn’t buy the argument, and he doesn’t want you to buy it, either. But he wants to fight fire with fire: Buy North Face products if you really think that the North Face is all that (and he’s explicit about that point), but really, the North Face is not. He’s just expressing that view in fleece.

The North Face’s right to pursue purveyors of related products with confusingly similar marks is unquestioned; some trademark lawyers would argue that the North Face has a duty to do so. In my view, there is nothing confusingly similar about the South Butt. Go get ‘em, Jimmy, and may the snark be with you.

Withought a doubt, the Chameleon is THE number one classic boot for the Altitude staff. One out of every two employees has this boot, and I am one of them. The Chameleon is well insulated with 200g of Polartec and 400g of Primaloft. It is the warmest out of the McMurdo and the B52 (see below). I especially like its aggressive Vibram sole. The molded rubber heal counter is for easily attaching snowshoes. When worn with pants, its rugged look has a simple style. I particularly like the exterier material which repels calcium. The proof: after a year of wear, Alex Lapointe’s boots still look like new.

The number 2 classic, the McMurdo, has almost the same insulation as the Chameleon does with 400g of Primaloft Eco. The Winter Grip sole is made by The North Face, distinguishing it from the Chameleon. According to my colleagues, this boot is comparable to the Chameleon. Between the two, honestly, it’s a question of comfort and style.

The number 3 classic (I promise this is the last time I’ll use this title), the B52, is similar to the first two boots with 400g of Thinsulate Ultra, instead of Primaloft. This synthetic insulation is, however, as warm as Primaloft. The Contragrip sole is made by Salomon and contrary to the first two models, it doesn’t have a snow shoe attachment. The B52 is great for short walks, or for the city, but would be better left behind on longer more intense hikes through deep snow. Note this is the only boot with a Gore-Tex membrane; the other companies use their own waterproof liners.

I chose the Bozeman because it is made of high quality leather and has a very different style than the previous boots. Other colours besides black exist! More of a city boot than the others, it is heavier and less insulted with 200g of Primaloft Eco. People who don’t get cold as easily might prefer this boot because they won’t sweat as much. Finding this balance is essential: when your feet sweat too much in a boot, moisture forms and soon they are freezing cold. Out of the whole group, I wouldn’t recommend the Bozeman for snow shoeing. Nonetheless, it comes up high over the ankle and has all the other great qualities necessary for winter sports.

The Snowkat II is closest to a running shoe. It is also insulated with 200 g of Primaloft Eco, the same as the Bozeman, and has a rubber heal counter for snow shoeing. The Snowkat sits lower on the ankle than the other boots, but some people prefer this style for the city. Using gaiters or pants with built-in gaiters would be a good idea when walking in deep snow. The sole is also a Winter Grip by North Face.

North Face Down Jacket Cleaning in CO2 vs. Dry Cleaning






Dry cleaning or laundering down filled garments tends to always be a problem for a dry cleaner, or for that matter just about anyone.

During dry cleaning or home washing the down (feathers) gets wet and clumps together horribly.

When drying you can put clean tennis balls or sneakers into the dryer to fluff up the feathers. The last time I washed my North Face jacket at home I ended up with a headache after listening to the sneakers bang in the dryer for over an hour.

I have never been a big fan of this as it adds a lot of "wear and tear" during the drying process and some of the feathers always seem to be stuck together somewhere.

Another issue with dry cleaning down garments is that the feathers always seem to retain a dry cleaning smell.

This week I put my
North Face down jacket into our CO2 dry cleaning machine, despite the fact that the label reads; Do Not Dry Clean. I wanted to see what the results would be.

My jacket was fairly soiled from stacking wood and other chores that I had done around the house over the weekend. It's also predominantly orange, so stains show easily.

I placed the jacket into our CO2 dry cleaning machine (our ECO2 Cleanse process) and 30 minutes later I was very surprised. My jacket looked brand new. The down was not clumped anywhere. And best of all...every stain was gone.

I took a sniff of my jacket, absolutely no odor.

The only downside was that the jacket was cold from cleaning in CO2, and it seemed slightly counterintuitive to walk outside into the brisk New Yok winter in an insulated cold jacket. so I had one of my finishers steam the jacket out to take the chill out. One of the great things about CO2 dry cleaning is that the process does not use heat to dry.

Final result. CO2 dry cleaning was able to clean my down jacket much better than any other process and in much less time.nike free run

A knock-off takes on The North Face

The North Face is one of the most popular wilderness brands. But the company isn't too happy about one aspiring teenage entrepreneur's knock-off brand called The South Butt. Adam Allington reports.

KAI RYSSDAL: When it comes to wilderness chic, there are few brands as popular as The North Face. Their fleeces and jackets have become a little bit like city folk driving those big SUVs. People buy 'em, even if they're never going to go off road. A teenage entrepreneur in Missouri figured the high-flying brand needed to be taken down a notch. So he started a company, and he called it "The South Butt."

The North Face is not laughing. From St. Louis Public Radio, Adam Allington has more.


ADAM ALLINGTON: You know, it's hard being an international retail powerhouse. Not only do you have to compete against knock-off brands and counterfeits, but every once in a while someone comes along and just hits below the belt.

Someone like 18-year old Jimmy Winkelmann and his company The South Butt.

JIMMY WINKELMANN: I feel that a large amount of people are buying The South Butt to go along with an anti-logo movement in general.

Winkelmann started The South Butt as a spoof of The North Face's fleece jackets worn by so many kids at his private prep school. North Face however didn't think the joke was that funny. They served Winkelmann with cease and desist papers as he left for the University of Missouri last fall. Ever since then, The South Butt has gotten the kind of publicity you just can't buy.

Jeff Davis works at one of three local shops that sell South Butt brand apparel.

JEFF DAVIS: It's been moving like crazy, you know all of the t-shirts, long-sleeve shirts and everything else has just been selling like mad. Christmas time was a big rush for it.

When the lawsuit went national -- 14 and a half million Google hits and counting -- South Butt went from turning a modest profit of a couple thousand dollars to paying for all four years of Jimmy's college. But the South Butt isn't the first company to poke fun at a popular brand.

JOE MARTINEAU: Yeah, the Lardashe case, where jeans were sold under the name "Lardashe."

MARTINEAU: Thus the name Lardashe.

In that case, Martineau says the court ruled in favor of Lardashe on the grounds the company was not misleading customers.

MARTINEAU: The court held that there was no confusion in the marketplace, that it was an obvious parody and that parody was protected under the First Amendment and was not a trademark infringement.

But Martineau says there are consequences for brands that don't defend their trademark. Just ask Aspirin or Kleenex.

MARTINEAU: If they did not take action -- they conceivable could risk, by not policing their trademark against potential infringing trademarks -- they could risk a claim that they'd abandoned their trademark.

North Face isn't commenting on the case, but the text of the lawsuit claims that The South Butt logo is similar to North Face and that's misleading customers. But Winkelmann's attorney, Albert Watkins says the only thing similar between North Face and South Butt is the word "The."

ALBERT WATKINS: This is about consumer choice, this is about a consuming public that's smart enough to know the difference between a face and butt and not believe that somehow when they pick up a butt they've bought a face.

For his part, Jimmy Winkelmann says he welcomes the opportunity to make his case in court and the experience is teaching him a lot.

WINKELMANN: I think what I learned is, your product matters, but it's really all sales and marketing, I think. That's all it is.

ALLINGTON: How much have you spent on advertising?

WINKELMANN: Zero dollars. North Face made the advertising for me.

Winkelmann had offered to sell his company to North Face for $1 million, an offer he has since retracted in light of South Butt's runaway success.

North Face, South Butt end up in court over logo

NEW YORK, Jan 8 (Reuters) - South Butt LLC says there's nothing behind a lawsuit demanding that its use of that name come to an end.

The company, formed in 2007 by St. Louis high school student James Winkelmann, this week called for the dismissal of a federal trademark lawsuit by The North Face Apparel Corp, a unit of VF Corp (VFC.N).

Known for its outdoor clothing, North Face sued South Butt in December to halt the sale of fleece jackets, T-shirts and other apparel with the South Butt name and logo.

Calling Winkelmann and South Butt "opportunists seeking to pirate its famous trademarks for their inferior knockoffs," North Face said the competing mark confuses customers and constitutes unfair competition.

It said it first became aware of South Butt when that company applied in August for a federal trademark and that South Butt's sales had grown as the dispute gained notice.

The North Face logo includes its name, and three arcs that resemble a mountainside. South Butt's logo has a similar typeface and two upside-down arcs that according to court papers are a "starkly stylized silhouette of a rump."

In a court filing this week, Winkelmann said his products are protected parody and that it is "patently erroneous" to suggest that consumers will be confused.

He added that even South Butt's tagline "Never Stop Relaxing" is simply a tongue-in-cheek contrast to North Face's tagline, "Never Stop Exploring."

"While Jimmy may have turned 19 years of age, and while he looks 14 and, to some, acts 12," the filing said, "Jimmy and The South Butt have no choice but to defend the present action to protect the integrity of the marketplace, freedom of choice for the consumer, freedom of speech for all, and the fundamental tenets of capitalism, competition and the American Way."

Winkelmann is now a sophomore at the University of Missouri at Columbia, campus records show. U.S. District Judge Rodney Sippel rescheduled on Friday a status conference in the case to Jan. 27, court records show.

The case, which includes a seller of South Butt products as a defendant, is The North Face Apparel Corp v. Williams Pharmacy Inc et al. U.S. District Court, Eastern District of Missouri, No. 09-02029.
